YouArtworks provides an AI-powered platform for creating custom portrait art and personalized gifts. Users can upload photos, generate AI artwork, and purchase physical or digital products featuring the generated art.

3. User Accounts

• You must provide accurate and complete information when creating an account.
• You are responsible for maintaining the security of your account credentials.
• You must be at least 13 years old to use the Service.
• You are responsible for all activity that occurs under your account.

4. Purchases & Payments

• All payments are processed securely through Stripe.
• Prices are listed in USD and may be subject to change.
• You agree to pay all charges associated with your orders.
• Refunds and returns are handled in accordance with our Return & Refund Policy.
• Credits purchased for AI image generation are non-refundable once used.

5. AI-Generated Content & Intellectual Property

• AI-generated artwork is created using your uploaded photos and our AI models.
• You retain ownership of the photos you upload.
• You receive a license to use AI-generated artwork for personal and commercial purposes upon purchase.
• We reserve the right to use anonymized, non-identifiable generated content to improve our Service.
• You must not claim AI-generated content as traditional human-created artwork in contexts where such a distinction is legally relevant.

6. User Content

• You are solely responsible for the content you upload.
• You must have the right to use any photos you upload (e.g., photos of your own pets or photos you have permission to use).
• By uploading content, you grant us a limited license to process, store, and use it for providing the Service.
• We may remove content that violates these terms or applicable law.

7. Prohibited Uses

You agree not to:

• Use the Service for any unlawful purpose.
• Upload content that infringes on third-party intellectual property rights.
• Upload harmful, abusive, or inappropriate content.
• Attempt to reverse-engineer, decompile, or disassemble any part of the Service.
• Use automated systems to scrape or extract data from the Service.
• Interfere with or disrupt the Service or its infrastructure.

8. Disclaimers & Limitation of Liability

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that AI-generated results will meet your expectations.

To the fullest extent permitted by law, YouArtworks shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

9. Termination

We may suspend or terminate your account at our discretion if you violate these Terms or for any other reason. Upon termination, your right to use the Service ceases immediately. You may request deletion of your data as described in our Data Deletion page.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located in California.
